Well you have their answer in the first paragraph,,,,,,,,,,,,,,, Tomatoes —  some consider them fruits, others say they're vegetables — but no matter what you call them, this time of year, tomatoes are delicious.                                 and I have to concur ,a this time of year,..they are great,.... and sure beat that store bought crap shipped in from all over (Mexico,California) etc etc,.............Your own backyard is the best barr none Just like strawberry's Homegrown ,.way better,..........   ...............but in keeping with the LAW as the USofA see's it ,.........and they know what's good for us.................................hahahahahhahaha            Here's another excerpy from the same page (too bad the rest of the world isn't on it.......hahahaha) In 1887, U.S. tariff laws that imposed a duty on vegetables but not on fruits caused the tomato's status to become a matter of legal importance. In 1893 the U.S. Supreme Court settled this controversy, declaring the tomato a vegetable. The case is known as Nix v.
